NYC Firefighter Accidents
Firefighters are the fearless protectors of life and property of New York City, and assume a great deal of risk to life and health in their chosen profession. This does not, however, exclude them from the same rights as civilians when it comes to compensation from injuries due to the illegal conduct or negligence of others. GML 205a and GOL 11-106 are the two main laws by which injured firefighters may seek compensation from the responsible party. GML 205a allows firefighters to claim compensation due for any injury suffered on the job as a result of violations of law, regardless of what type of law was broken or where the violation took place. So they are covered whether the injury occurs responding to a dangerous blaze, being injured during a drill by a defective piece of equipment, or having something fall on their heads back at the firehouse. GOL 11-106 (General Obligations Law) allows firefighters the same rights as civilians in the recovery from injuries caused by someone else’s negligence. In the past firefighters fully assumed the risks that came with the job regardless of the conditions they had to dive into. The new rules say that if a firefighter is injured due to illegal or negligent behavior of another in the course of their duty (such as blocked stairwells, improperly maintained egress, etc.) they have the right to seek compensation.
